A trade mark is any sign which can distinguish the goods and services of one trader from those of another. A sign includes, for example, words, logos, pictures, or a combination of these. Basically, a trade mark is a badge of origin, used so that customers can recognise the product of a particular trader. To be registrable your trade mark must be; distinctive for the goods or services which you are applying to register it for, not deceptive, or contrary to law or morality, not similar or identical to any earlier marks for the same or similar goods or services.

Registering your trade mark gives you the exclusive right to use your mark for the goods and/or services that it covers in the United Kingdom (UK).

If you have a registered trade mark you can put the ® symbol next to it to warn others against using it. However, using this symbol for a trade mark that is not registered is an offence.

A registered trade mark:

The initial fee for Trade Mark Registration – in one class – is £465.00 plus VAT and includes the issue of the Registration Certificate. If the Registry refuses to accept the application and decrees that the mark will not be acceptable under any circumstance, £315.00 plus VAT will be refunded.

If however, the mark can be amended to satisfy the Registry requirements, the application can be resubmitted with the additional fee of £150.00 plus VAT.

If the mark applies to more than one class, the fee for each additional class is £50.00 plus VAT.
