Trademarks
A trade mark is any sign which can distinguish the goods and services of one trader from those of another. A sign includes, for example, words, logos, pictures, or a combination of these.
Basically, a trade mark is a badge of origin, used so that customers can recognise the product of a particular trader.
To be registrable your trade mark must be; distinctive for the goods or services which you are applying to register it for, not deceptive, or contrary to law or morality, not similar or identical to any earlier marks for the same or similar goods or services.
Stage 1
It is necessary to check the availability and non-sensitivity of the Trademark you wish to register. This takes approximately 10 working days and costs £120 plus VAT. If Stage 1 is clear on both counts you can then proceed to Stage 2.
Stage 2
The fee for the final application for Stage 2 is £370 plus VAT plus £50 for each additional class you may wish to register against your mark – there are 45 classes in total. Once the application is accepted it is advertised in the Trademark Journal for 13 weeks and if no objections are raised a certificate will be issued within a further 4-6 weeks.
Registration Fee
At the conclusion of stages 1 and 2 the certificate is issued subject of a final payment of £95.00.
